Terms of Service — Toshema

These terms govern your use of the Toshema mobile app and the toshema.com website (together, the “service”), operated by Toshema (“we”, “us”). By creating an account or using the service you agree to them. If you do not agree, please do not use the service.
Our Privacy Policy explains what we collect and why, and forms part of these terms.
What the service is
Toshema provides recorded Torah shiurim — video and audio lessons on the daily amud — together with study materials, a learning schedule, and a place to comment. It is offered for personal study and is free to use. Donations are voluntary and are never required for access.
The service is not a substitute for learning with a rav. Nothing in a shiur, a comment or a study document is halachic, legal, medical or financial advice, and it should not be relied on as a psak.
Your account
- You sign in with Google or Apple. Keep control of that sign-in — anything done through your account is treated as done by you.
- One account per person. Do not share it, sell it, or let someone else use it.
- If you are under 13, do not create an account. Between 13 and the age of majority where you live, use the service with a parent’s or guardian’s permission.
- You can delete your account at any time from Profile → Delete account in the app, or by writing to shiur@toshema.com. What happens to your information afterwards is set out in the Privacy Policy.
Acceptable use
Please do not:
- Copy, re-upload, re-publish, sell or redistribute the shiurim or study materials, or make them available on another platform or feed. You may download them within the app for your own offline learning.
- Post anything unlawful, abusive, hateful, threatening, obscene, deliberately misleading, or that infringes somebody else’s rights.
- Impersonate another person, or post someone’s private information.
- Use the service to advertise, solicit or spam.
- Scrape the service, run automated requests against it, or attempt to interfere with, overload, reverse-engineer or gain unauthorised access to it or to another user’s account.
- Strip, obscure or alter any credit, watermark or notice on the content.
Comments and dedications
You keep ownership of what you write. By posting a comment or a dedication you give us a non-exclusive, worldwide, royalty-free licence to display and store it as part of the service, and you confirm you have the right to post it.
Comments are public to other learners. We may remove a comment, or suspend an account, where something breaches these terms — but we do not pre-screen what is posted, and a comment is the view of the person who wrote it, not ours. If you see something that should not be there, write to shiur@toshema.com.
A dedication is a zchus given in someone’s merit and stays with the learning it sponsored, so dedications and comments are retained after account deletion as described in the Privacy Policy. Ask us and we will remove a particular comment.
Donations
- Donations are processed by Stripe. Card details go directly to Stripe; we never see or store them.
- A donation supports the recording and hosting of the shiurim. It does not buy access, membership or any other benefit.
- Donations are non-refundable once processed. If a donation was made in error or charged incorrectly, write to us within 30 days and we will put it right.
- If you set up a recurring donation you may cancel it at any time; the cancellation applies to future payments, not to ones already taken.
- We are not able to give tax advice. If you need a receipt for a donation, ask us.
Content and ownership
The shiurim, recordings, written materials, the Toshema name and the app itself belong to us or to the person who created them, and are protected by copyright. These terms give you a personal, revocable, non-transferable permission to use the service for your own learning — nothing more.
Some material is served by others: Talmud page images come from outorah.org, and classical texts are in the public domain. Those remain the property or responsibility of their sources.
If you believe something on the service infringes your copyright, write to shiur@toshema.com identifying the material and where it appears, and we will look into it and remove it where the claim is made out.
Availability and changes
We aim to keep the service running and the daily shiur available, but we cannot promise it will be uninterrupted or error-free. We may change, suspend or discontinue any part of it, and we may update the app — including automatically, so that fixes reach you.
We may suspend or close an account that breaches these terms. You may stop using the service at any time.
Disclaimer
The service is provided “as is” and “as available”. To the extent the law allows, we make no warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or that the content is accurate, complete or uninterrupted.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost data or lost profits, arising out of your use of the service. Where liability cannot be excluded, it is limited to the greater of the amount you donated in the twelve months before the claim, or £50.
Nothing here limits liability that cannot lawfully be limited, and if you are a consumer you keep the rights your local law gives you.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of the law where you live, or of any right to bring a claim in your local courts.
Changes to these terms
We may update these terms. We will post the new version here and update the date above, and notify significant changes in the app. Continuing to use the service after a change means you accept the updated terms.
